Central London Fencing Club
Membership, Beginners Course and Taster Class Terms and Conditions
Legal operator: Central London Fencing Club Ltd (Company No. 14193019)
Contact: [email protected]
Governing law: England and Wales
These terms must be provided before booking or renewal. The Club’s statutory obligations and participants’ statutory rights take precedence over any inconsistent wording.
1. Introduction and acceptance
1.1. These Terms and Conditions govern membership of Central London Fencing Club (“the Club” or “CLFC”) and participation in its fencing activities.
1.2. By applying for or renewing membership, the member agrees to these Terms and Conditions, the Club’s Code of Conduct, and the Equipment Price List supplied at the time of joining or renewal.
1.3. Members under 18 must have these terms accepted by a parent or legal guardian, who will be responsible for payments and contractual obligations.
1.4. The Club will provide members with a copy of these terms before they commit to membership. Any material changes will be communicated in advance and will not retrospectively alter an existing paid membership term without agreement or a lawful basis.
1.5. Nothing in these terms excludes or restricts members’ statutory consumer rights.
2. Membership and term dates
2.1. Membership is purchased for a defined term, the dates and scheduled sessions of which will be communicated before payment through the website.
2.2. Membership fees entitle the member to attend the sessions included in their membership category, subject to availability, safety requirements and these terms.
2.3. Membership does not guarantee individual coaching, participation in competitions or exclusive access to particular facilities.
2.4. Membership is personal and cannot be transferred without the Club’s written agreement.
2.5. The Club may refuse a new membership application on reasonable, lawful grounds, including capacity, suitability of the programme or safety considerations.
3. Fees and payments
3.1. Membership fees, equipment hire charges and applicable payment arrangements will be published on the Club website or otherwise disclosed before booking.
3.2. Membership fees must be paid in full within seven calendar days of the official start of the Club term, irrespective of the member’s first attendance, unless the Club agrees otherwise in writing. A member joining after the term begins must pay before their first session, unless otherwise agreed in writing.
3.3. The Club may issue a reminder and, after reasonable notice and an opportunity to correct a payment error, suspend attendance while fees remain overdue.
3.4. Persistent non-payment may lead to termination under Section 11.
3.5. Members remain liable for sums properly incurred before termination. The Club will not charge for services it has not provided except where a lawful, fair cancellation provision applies.
4. Club equipment
4.1. Introductory access
Participants booked onto a Beginners Course or Taster Class may use suitable Club equipment during their scheduled classes at no additional hire charge. New members may use available Club equipment without an additional hire charge for the first calendar month from the commencement of their membership. Attendance at a Course or Taster Class does not restart this introductory month.
Equipment required for scheduled Beginners Courses, Taster Classes and organised coaching activities takes priority over general member use. All loans remain subject to availability, fit, safety and coaching instructions.
4.2. Equipment after the introductory month
After their introductory month, members must supply all equipment necessary for safe participation or purchase the Equipment Hire Add-on for £300 per Club term, in addition to membership fees. Equipment hire is available only to active members, not one-off guests, unless the Club expressly agrees otherwise. Members who own only part of the required equipment must purchase the full add-on to borrow the remaining items. The published full-term price applies unless the Club offers a different rate in writing; where membership or the add-on is terminated early, Section 9.5 governs refunds.
4.3. Scope of equipment hire
The add-on permits reasonable use of available Club equipment during authorised Club activities. It does not confer ownership, exclusive access to a particular item or permission to remove equipment from the venue without written approval. The Club remains responsible for supplying reasonably safe and suitable equipment.
4.4. Use and care
Users must follow reasonable instructions, visually check equipment before use, report suspected defects and breakages promptly, use equipment only as intended, refrain from unauthorised alteration or repair, stop using unsafe items and return borrowed items to their designated location. The Club may withdraw equipment for inspection, repair or replacement.
4.5. Unauthorised use
Members without introductory access or a current Equipment Hire Add-on must not use Club equipment without express permission. Repeated breaches may lead to withdrawal of borrowing privileges and action under Section 11.
5. Equipment damage, loss and replacement
5.1. Responsibility
Members must take reasonable care of equipment entrusted to them.
A participant who causes loss or damage through negligence, deliberate conduct, misuse, unauthorised modification or breach of reasonable equipment instructions may be required to pay the Club’s reasonable, evidenced repair or equivalent replacement costs.
5.2. Assessment of damage
Before requesting reimbursement, the Club will consider the available evidence, including:
- The circumstances of the incident.
- Whether the equipment was being used appropriately.
- Any available photographs, inspection records or witness accounts.
- Whether repair is safe and economically reasonable.
The Club will explain the basis of any charge and give the member a reasonable opportunity to respond.
5.3. Equipment Price List
The Club will maintain a published Equipment Price List in Schedule A.
The list provides advance notice of replacement prices. Charges for damage will be limited to the Club’s reasonable, evidenced loss, taking account of the condition and value of the item, reasonable repair options and any betterment arising from replacement.
The Club will not impose punitive charges.
5.4. Replacement with equivalent equipment
Where a member is responsible for replacing damaged equipment, the Club may accept a replacement item instead of payment.
Any replacement must be:
- Of equivalent type and appropriate specification.
- Safe, functional and suitable for the intended fencing activity.
- In a condition reasonably comparable to the item before it was damaged.
- Inspected and accepted by the Club before being put into use.
A broken, unsafe or materially inferior item will not satisfy the replacement obligation.
5.5. Disputed damage
A member may dispute a damage charge in writing.
The Club will review the dispute fairly, consider relevant evidence and provide a written response.
A member will not be treated as having accepted liability solely because they reported a breakage.
6. Code of Conduct
6.1. General standards
All members must behave politely, respectfully and responsibly towards:
- The Club owner.
- Coaches, instructors and volunteers.
- Other members and their families.
- Visitors, venue staff and officials.
- Other participants in Club activities.
These standards apply during training, competitions, Club events, telephone conversations, messaging groups, and communications relating to the Club.
6.2. Unacceptable conduct
The following conduct may constitute a breach of these terms:
- Shouting at, threatening, intimidating or verbally abusing another person.
- Harassment, bullying, discriminatory abuse or repeated unwanted personal remarks.
- Aggressive, hostile or persistently disruptive behaviour.
- Deliberately humiliating, targeting or personally insulting another member, coach or Club representative.
- Repeatedly refusing to follow reasonable safety or operational instructions.
- Misusing Club communication channels to harass others or repeatedly disrupt Club activities.
- Retaliating against someone for raising a genuine concern or complaint.
6.3. Disagreements and complaints
Members are entitled to disagree with Club decisions, raise concerns, make reasonable criticism and submit complaints.
Disagreements must be expressed without threats, abuse, harassment or intimidation.
Good-faith complaints, truthful accounts of experiences, lawful reviews and reasonable criticism will not in themselves constitute misconduct.
Members are encouraged to raise individual payment, equipment and membership disputes privately with Club management in the first instance.
6.4. Club communication groups
Club messaging groups are primarily intended for training information, scheduling, equipment enquiries, competitions and constructive Club-related discussion.
Members must not use these groups to harass, threaten or personally abuse others.
The Club may moderate messages or remove members from Club-managed communication groups where reasonably necessary to protect participants or maintain orderly communication.
6.5. Conduct of Club representatives
The Club owner, coaches and other representatives are also expected to communicate professionally and respectfully.
Members may raise concerns about their conduct without fear of retaliation.
7. Health and safety
7.1. Members must follow reasonable instructions concerning fencing safety, protective equipment and use of the venue.
7.2. Members must use appropriate protective equipment suitable for their activity and comply with applicable competition or governing-body requirements where relevant.
7.3. Members must not knowingly use damaged or unsafe equipment.
7.4. Members should inform coaches of any relevant limitation affecting safe participation, where appropriate, without being required to disclose unnecessary medical information.
7.5. The Club may temporarily prevent participation where there is a reasonable and immediate safety concern.
7.6. Fencing carries inherent sporting risks. Members acknowledge those ordinary risks, but nothing in these terms excludes the Club’s liability for death or personal injury caused by negligence or any other liability that cannot lawfully be excluded.
8. Attendance and missed sessions
8.1. Members are responsible for attending their scheduled sessions.
8.2. Sessions missed for personal reasons are not automatically refundable.
8.3. Where the Club cancels a scheduled session, it will offer a suitable replacement session or an appropriate refund or credit, consistent with members’ statutory rights.
8.4. The Club will communicate material timetable changes as soon as reasonably practicable.
9. Cancellation by the member
9.1. Members may terminate their membership at any time by giving written notice to the Club.
9.2. Termination will take effect on receipt of the notice, or on a later date specified by the member.
9.3. The member will receive a pro-rata refund for unused scheduled sessions remaining in the paid membership term.
9.4. The refund will be calculated as:
Membership refund = membership fee paid × unused scheduled sessions ÷ total scheduled sessions included in the paid term.
Sessions already delivered before the effective termination date count as used for this calculation, whether or not the member attended them, subject to statutory rights.
9.5. Where an Equipment Hire Add-on has been purchased, the unused portion will also be refunded proportionately, based on the remaining period of the add-on, unless a more favourable arrangement is agreed.
9.6. There is no general membership cancellation penalty.
10. Refunds and outstanding equipment charges
10.1. The Club may seek payment for equipment loss or damage for which a member is responsible under Section 5.
10.2. Where liability and the amount are agreed in writing, the Club may, with the member’s agreement, deduct the outstanding amount from the membership refund and provide an itemised calculation.
10.3. Alternatively, the member may discharge an agreed replacement obligation by providing an acceptable replacement item under Section 5.4.
10.4. Where an equipment charge is disputed, the Club will review the evidence and explain the proposed charge in writing. A disputed charge will not automatically delay an otherwise due membership refund; the Club may pursue a properly evidenced claim separately. Agreed deductions require the member’s agreement.
10.5. Where an agreed deduction exceeds the refund, any remaining amount will be separately invoiced.
10.6. Refunds will normally be processed within 14 days of the effective termination date, subject to any shorter deadline required by law.
10.7. The Club will provide a written breakdown of any refund and agreed deduction.
11. Termination by the Club
11.1. General right
The Club may terminate membership at any time on reasonable, lawful grounds by giving written notice. For minor or remediable matters it will normally offer an opportunity to respond or improve; serious misconduct or safety risks may justify immediate termination.
Examples include:
- Serious or repeated breaches of the Code of Conduct.
- Threatening, abusive or intimidating behaviour.
- Significant or repeated safety breaches.
- Persistent non-payment following reasonable reminders.
- Repeated misuse of Club equipment.
- Conduct that materially disrupts Club activities or the safety and wellbeing of others.
- Closure or substantial alteration of the relevant programme.
11.2. Warnings and opportunity to respond
For minor or remediable breaches, the Club will normally explain the concern and provide a reasonable opportunity to respond or improve.
The Club may terminate membership immediately, without a prior warning, where the circumstances reasonably justify doing so, including serious misconduct, threats, harassment or significant safety concerns.
11.3. Refund following termination
Where the Club terminates membership, it will refund unused scheduled sessions in accordance with Section 9, together with the unused portion of any Equipment Hire Add-on.
Any equipment charges will be dealt with separately under Sections 5 and 10.
11.4. Access following termination
Once membership ends, the former member must stop attending Club activities unless invited or otherwise authorised.
The Club may remove access to Club-managed member communication groups and facilities where appropriate.
Termination does not prevent either party from pursuing legitimate outstanding claims or exercising statutory rights.
12. Suspension
12.1. The Club may temporarily suspend a member where reasonably necessary to investigate serious misconduct, protect participants or address an immediate safety concern.
12.2. The Club will communicate the reason for suspension, its expected duration where known, and how the member may respond.
12.3. Any unused paid sessions lost solely because of a Club-imposed suspension will be refunded, credited or rescheduled unless a different treatment is fair, lawful and expressly agreed.
12.4. Suspensions will be reviewed promptly and will not continue indefinitely without justification.
13. Complaints and dispute resolution
13.1. Members may submit complaints in writing to the Club’s designated contact email.
13.2. The Club will acknowledge complaints within five working days and aim to provide a substantive response within 14 working days.
13.3. Where further investigation is necessary, the Club will explain the delay and provide a revised response date.
13.4. Complaints will be considered fairly, including complaints about the Club owner or coaches.
13.5. Nothing in this procedure prevents a member from seeking independent advice, contacting an appropriate authority or exercising legal rights.
14. Safeguarding and welfare
14.1. All members must comply with the Club’s safeguarding arrangements and reasonable welfare instructions.
14.2. Bullying, harassment, abuse, grooming, exploitation and inappropriate conduct towards children or vulnerable participants are prohibited.
14.3. Safeguarding concerns should be reported through the Club’s designated safeguarding procedure.
14.4. The Club may take immediate proportionate protective measures where a safeguarding concern arises.
15. Personal information and photography
15.1. The Club will process personal information in accordance with applicable UK data protection law and its separate Privacy Notice.
15.2. The Club will explain the purposes for which it collects membership, attendance and emergency-contact information.
15.3. Promotional photography and filming will be governed by the Club’s separate photography and consent arrangements, including appropriate protections for children.
16. Changes to terms
16.1. The Club may update these terms for future membership periods.
16.2. Members will be informed of material changes before renewal.
16.3. Changes affecting an existing paid term will require agreement or an appropriate lawful basis. Where a material change disadvantages a member, the Club will provide an appropriate remedy, which may include cancellation and a pro-rata refund.
17. Governing law
These terms are governed by the law of England and Wales.
Nothing in this clause removes any mandatory legal protection or right to bring proceedings in a court available to the member under applicable law.
18. Acceptance of Terms Through Attendance
18.1. These Terms and Conditions apply to all individuals attending or participating in CLFC training sessions, lessons, competitions, open fencing sessions and other Club-organised activities, including members, guests, visitors and trial participants.
18.2. By registering for, booking or attending a Club session, participants acknowledge and agree to comply with these Terms and Conditions, provided they have been given reasonable notice of the terms and an opportunity to review them before attending.
18.3. Participation in any subsequent Club session constitutes continued acceptance of the Terms and Conditions applicable to that session, where those terms have been properly communicated and incorporated into the participation agreement.
18.4. Participants who do not agree to these Terms and Conditions must notify the Club before participating. Any applicable cancellation or refund rights will remain unaffected.
18.5. For participants under the age of 18, acceptance of contractual obligations must be provided by a parent or legal guardian. All participants, regardless of age, must comply with the Club’s reasonable safety instructions and Code of Conduct.
19. Pre-existing Medical Conditions, Injuries and Fitness to Participate
19.1. Fencing is a physically demanding sport involving rapid movements, lunges, changes of direction and other activities that may place stress on muscles, joints and the cardiovascular system. Participation carries inherent risks of injury, including the possible aggravation of pre-existing injuries or medical conditions.
19.2. Each participant is responsible for making a reasonable assessment of their fitness to participate and, where appropriate, obtaining advice from a qualified healthcare professional before attending a session.
19.3. Participants with pre-existing injuries, medical conditions or physical limitations that may affect their ability to participate safely are expected to inform the Club or their coach of any relevant practical restrictions before participating, to the extent reasonably necessary for safe participation. Participants are not required to disclose unrelated or unnecessary medical information.
19.4. Participants must not undertake exercises or fencing activities that they know, or reasonably ought to know, would create an unacceptable risk to their health. They must stop participating and notify a coach if they experience pain, dizziness, unusual discomfort or other symptoms that may indicate a risk of injury.
19.5. By choosing to participate, individuals acknowledge that fencing may aggravate an existing injury or medical condition, even where appropriate safety precautions are taken. They voluntarily accept the ordinary and inherent risks of participation, including the risk of aggravation not caused by negligence or other breach of legal duty by the Club.
19.6. The Club will not be responsible for the worsening of a pre-existing injury or medical condition solely because the participant voluntarily undertook an activity involving ordinary, inherent sporting risks, where the Club and its representatives have exercised reasonable care and complied with their legal obligations.
19.7. The Club, its owner, coaches and authorised representatives retain their legal duties to exercise reasonable care, provide reasonably safe equipment and activities, and respond appropriately to known or reasonably foreseeable safety risks.
19.8. Nothing in this section excludes or restricts liability for death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or restricted.
19.9. The Club may reasonably modify, restrict or decline participation in particular activities where necessary to manage a genuine safety risk, taking account of the participant’s circumstances and any reasonable adjustments required by applicable equality legislation.
20. Compliance with Coaching Instructions and Responsibility for Safe Participation
20.1. Obligation to follow instructions
All participants must comply with reasonable instructions issued by the Club owner, coaches, instructors and authorised representatives concerning safety, equipment, training activities and participation.
20.2. Participation despite injury or illness
Participants must not knowingly continue fencing or undertake exercises where doing so presents an unreasonable risk of injury or aggravation of an existing medical condition.
Participants experiencing pain, dizziness, significant discomfort or other symptoms affecting their ability to participate safely must stop the activity and inform a coach.
20.3. Instructions to stop or modify participation
The Club owner, coaches and authorised representatives may instruct a participant to stop, modify or refrain from an activity where they reasonably believe continued participation could create a safety risk.
Participants must comply immediately with such instructions.
20.4. Refusal to follow safety instructions
Where a participant refuses to follow reasonable safety instructions, the Club may:
- Require the participant to stop the activity immediately.
- Exclude the participant from the remainder of the session.
- Suspend participation pending a safety review.
- Terminate membership in accordance with Section 11 where the seriousness or repetition of the conduct reasonably justifies termination.
20.5. Responsibility for disregarding instructions
A participant who knowingly disregards a clear and reasonable safety instruction acknowledges that doing so may increase the risk of injury, including aggravation of a pre-existing condition.
Where injury results from a participant’s own unreasonable conduct or failure to follow appropriate safety instructions, that conduct may be taken into account when determining legal responsibility.
The Club will not automatically be responsible for injury arising solely from a participant’s voluntary and unreasonable disregard of appropriate safety instructions, provided the Club and its representatives have fulfilled their own legal duties.
20.6. No obligation to continue an activity
Participants may stop or decline any exercise or fencing activity where they reasonably believe participation would endanger their health or safety.
No participant will be penalised for raising a genuine safety concern or declining an activity on reasonable health or safety grounds.
20.7. Club’s continuing duty of care
The Club will take reasonable steps to provide safe training activities, appropriate supervision and reasonably safe equipment.
Nothing in this section excludes or restricts liability for death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or restricted.
21. Beginners Course booking, changes and cancellation
21.1. These provisions apply to all CLFC Beginners Courses. The course dates, times, venue, price and number of lessons will be specified before booking.
21.2. Full payment is required to secure a place unless otherwise agreed in writing. Suitable Club equipment is provided during scheduled course lessons at no additional hire charge.
21.3. All requests to cancel, transfer, reschedule or otherwise change a booking must be sent in writing to [email protected]. The Club must receive the request at least 48 hours before the scheduled start time of the first lesson for the participant to qualify for a refund or, subject to availability, a transfer to another course.
21.4. Requests received less than 48 hours before the first scheduled lesson are not ordinarily eligible for a refund, credit or transfer. The Club may consider exceptions at its discretion; this provision does not limit statutory rights. Any sum retained must be fair and proportionate, taking account of the Club’s actual or reasonably anticipated loss and any costs saved or place refilled.
21.5. Missed lessons, lateness or inability to attend for personal reasons do not automatically entitle a participant to a refund or make-up session, subject to statutory rights. The Club may offer a substitute lesson where practical.
21.6. If the Club cancels the whole course before it begins, participants may choose a full refund or an available alternative course. If the Club cancels individual lessons, it will offer appropriate replacement lessons or a proportionate refund, consistent with applicable rights.
21.7. Participants are subject to the Club’s general Terms and Conditions, Code of Conduct, equipment rules and safety requirements.
22. Taster Class booking, changes and cancellation
22.1. These provisions apply to all CLFC Taster Classes. Full payment is required to secure a place unless otherwise agreed in writing. Suitable Club equipment is provided during the class at no additional hire charge.
22.2. All cancellation and rescheduling requests must be submitted in writing to [email protected]. The notice period is measured from the scheduled start time of the class to the time the Club receives the written request.
22.3. At least 48 hours before the class: the participant may receive a full refund or rebook another available Taster Class without charge.
22.4. Less than 48 hours but at least 24 hours before the class: the participant may request a refund less a £10 administration charge, or rebook an available Taster Class on payment of a £10 administration charge. The charge is intended to reflect reasonable administration costs and will not be imposed to the extent it would be unfair or unlawful.
22.5. Less than 24 hours before the class, or in the event of non-attendance: there is no ordinary entitlement to a refund, credit or rebooking.
22.6. The Club may refuse admission to a participant arriving too late to receive essential safety instructions, without an automatic refund entitlement, subject to statutory rights.
22.7. If the Club cancels the class, the participant may choose a full refund or an available replacement class at no extra charge.
22.8. Participants are subject to the Club’s general Terms and Conditions, Code of Conduct, equipment rules and safety requirements.
23. Personal Belongings and Valuables
23.1. Responsibility for personal belongings
All members, participants, guests and visitors are responsible for the safekeeping and security of their personal belongings while attending Club premises, training sessions, competitions or other Club-organised activities.
23.2. Loss, theft or damage
The Club does not accept responsibility for the loss, theft, disappearance or damage of personal belongings, including but not limited to clothing, bags, mobile phones, wallets, jewellery, electronic devices, fencing equipment and other valuables, except where such loss or damage results from the Club’s negligence, breach of contract or another legal obligation for which liability cannot lawfully be excluded.
23.3. Unattended belongings
Personal belongings must not be left unattended. The Club does not provide secure storage facilities unless expressly stated otherwise. Any storage areas made available are provided for convenience and do not constitute a guarantee of security.
23.4. Personal fencing equipment
Members are responsible for the maintenance, security and safekeeping of their privately owned fencing equipment. The Club is not responsible for loss or damage arising from ordinary use, accidental breakage or the actions of third parties, except where the Club is legally responsible.
23.5. Unclaimed property
Items found at Club premises may be held as lost property for a reasonable period. The Club will take reasonable steps to facilitate their return where the owner can be identified. Unclaimed items may subsequently be dealt with in accordance with applicable law.
23.6. Statutory rights
Nothing in this section excludes or restricts liability that cannot lawfully be excluded or restricted under applicable law, including liability for death or personal injury caused by negligence.
24. Guests, Visitors and Non-Members
24.1. Admission and participation
The Club may permit non-members to attend designated training sessions, open fencing sessions or other Club activities on payment of the applicable guest fee or with prior authorisation from the Club.
Admission and participation are subject to availability, suitability of the session, compliance with safety requirements and the Club’s discretion exercised on reasonable and lawful grounds.
The Club reserves the right to refuse participation where necessary for safety, safeguarding, capacity, previous misconduct or other legitimate operational reasons.
24.2. Guest fees and membership privileges
Payment of a guest fee permits attendance at the specific session or activity for which it has been paid.
Guest attendance does not constitute Club membership and does not entitle the guest to membership benefits, priority booking, equipment hire or access to other sessions.
Guest fees must be paid before participation unless otherwise agreed in writing.
24.3. Equipment requirements
Non-members attending on a guest fee must provide their own complete, suitable and safe fencing equipment unless the Club expressly authorises the use of Club equipment.
The Equipment Hire Add-on is available exclusively to Club members and cannot be purchased by guests or other non-members.
Participants attending an organised Beginners Course or Taster Class are entitled to use Club equipment during their scheduled classes in accordance with Section 4.
24.4. Compliance with Club rules
All guests, visitors and non-members must comply with the applicable provisions of these Terms and Conditions, including the Code of Conduct, equipment rules, health and safety requirements and reasonable instructions issued by the Club owner, coaches and authorised representatives.
Guests must be given reasonable notice of the applicable terms before booking or participating.
24.5. Responsibility for damage
Guests and non-members must take reasonable care of Club equipment and facilities.
Where a guest or non-member causes loss or damage through negligence, misuse, deliberate conduct or failure to follow reasonable instructions, the Club may seek reimbursement of its reasonable repair or replacement costs in accordance with Section 5.
24.6. Spectators and accompanying visitors
Spectators, parents, guardians and other accompanying visitors must remain in designated areas and must not enter fencing pistes, coaching areas or equipment storage areas without permission.
They must not interfere with coaching, training activities or the safe conduct of fencing sessions.
Children accompanying participants must be appropriately supervised by their parent, guardian or another responsible adult unless they are formally enrolled in a supervised Club activity.
24.7. Removal and refusal of future admission
The Club may require a guest, visitor or non-member to leave a session or the venue where their behaviour creates a safety risk, breaches the Code of Conduct, seriously disrupts Club activities or otherwise provides reasonable grounds for removal.
The Club may refuse future guest bookings on reasonable, lawful grounds, including serious or repeated misconduct.
Any refund due following removal or refusal of admission will be assessed in accordance with applicable booking terms and statutory consumer rights.
24.8. No automatic right to membership
Attendance as a guest, visitor, Beginners Course participant or Taster Class participant does not guarantee acceptance into Club membership.
25. Alcohol, Drugs and Impairment
25.1. Fitness to participate
All participants must be physically and mentally capable of taking part in fencing activities safely.
25.2. Alcohol and drugs
Participants must not engage in fencing, coaching exercises or other potentially hazardous Club activities while under the influence of alcohol, recreational drugs or any substance that materially impairs their coordination, judgement, balance, reaction time or ability to participate safely.
25.3. Medication and medical conditions
Participants taking prescribed or over-the-counter medication that may affect their ability to participate safely are responsible for assessing the relevant risks and, where appropriate, obtaining medical advice before participating.
Participants should inform a coach of any relevant practical limitations where reasonably necessary for safe participation. They are not required to disclose unnecessary or unrelated medical information.
25.4. Refusal of participation
Where the Club owner, a coach or an authorised representative reasonably believes that a participant is impaired or otherwise unfit to participate safely, the Club may:
- Refuse participation in the session.
- Require the participant to stop fencing immediately.
- Exclude the participant from the remainder of the session.
- Suspend participation pending a safety assessment.
- Terminate membership in accordance with Section 11 where the seriousness or repetition of the conduct reasonably justifies termination.
25.5. Responsibility for unsafe participation
Participants must comply with reasonable instructions to stop or modify their activities where impairment or another safety concern is identified.
A participant’s decision to disregard such instructions may be taken into account when determining responsibility for any resulting incident or injury.
Nothing in this section excludes or restricts the Club’s liability for negligence or any other liability that cannot lawfully be excluded.
26. Emergency Procedures and Venue Evacuation
26.1. Venue emergency procedures
Central London Fencing Club operates at Grey Coat Hospital School.
All members, guests, participants, spectators and visitors must comply with the emergency, fire safety and evacuation procedures applicable to the venue at which the activity takes place.
26.2. Compliance with instructions
In the event of a fire alarm, emergency, evacuation or other incident requiring immediate action, all persons attending Club activities must promptly follow reasonable instructions issued by:
- The venue’s authorised staff or emergency coordinators.
- Emergency services personnel.
- The Club owner, coaches or other authorised Club representatives.
26.3. Evacuation
Where evacuation is required, participants and visitors must:
- Stop all fencing and other activities immediately.
- Leave equipment behind where necessary to evacuate safely.
- Follow the designated evacuation routes and instructions applicable to the venue.
- Proceed to the designated assembly point.
- Remain outside the building until authorised to return.
- Avoid obstructing emergency exits, evacuation routes or emergency personnel.
26.4. Emergency assistance
The Club may contact emergency services and take reasonable steps to obtain appropriate assistance where a participant or visitor appears to require urgent medical attention.
The Club will follow applicable safeguarding, first-aid and emergency procedures.
26.5. Failure to comply
Refusal to comply with reasonable emergency or evacuation instructions may result in immediate exclusion from Club activities and, where justified, suspension or termination of membership under Section 11.
26.6. Club responsibilities
The Club will take reasonable steps to familiarise its coaches and authorised representatives with the venue’s applicable emergency arrangements and communicate relevant instructions to participants.
Nothing in this section excludes or restricts the Club’s legal duties concerning health, safety, supervision or emergency response.
